What is an Impressum?
An Impressum is a legally required provider identification on all business websites in Germany, Austria and Switzerland. It must contain the full name, address, contact details and legal registration information of the website operator or company.
Is an Impressum mandatory for private blogs?
Yes — if your blog shows advertising, promotes products/services or generates income (including via affiliate links), this counts as a business activity under German law. Purely private, non-monetised blogs may be exempt, but courts often rule against vague claims of a "non-commercial" intent.
What information must my Impressum contain?
Under the law (§ 5 DDG — Digital Services Act, successor to the TMG since 14 May 2024) you must state:
- The full legal name(s) of the person or company
- The registered business address (no P.O. box)
- Phone number, email and, where applicable, fax
- VAT ID (if registered for VAT)
- Register court and registration number (for companies: commercial register)
- Professional chamber and admission details (e.g. for lawyers, doctors)
- Person responsible for content (if different from the operator)
Can I use a template from your generator?
Yes. Our generator creates legally compliant templates based on current German law (as of 2026). All fields are pre-filled with placeholders that you must replace with correct details. Do not leave any field empty.
What happens if I don't have an Impressum?
A missing or incomplete Impressum can lead to a fine of up to €50,000, imposed by the competent supervisory authority under § 5 DDG. Independently of this, competitors and qualified bodies can issue a warning letter (Abmahnung) under the Act Against Unfair Competition (UWG). Competitors cannot impose fines themselves, but a warning can require you to reimburse their legal costs — so even a single complaint from a competing business can become expensive.
Do I need an Impressum if my site is hosted outside Germany?
Yes. If your website targets German users (e.g. it is in German, accepts EUR payments, uses a .de domain), German law applies regardless of the server location. EU-wide rules also require compliance for cross-border services.
Can I use a virtual office address?
No. The address must be the actual location where the business is operated or legally registered. Virtual offices (e.g. Regus) are only permitted if they are officially registered with the local trade office and you receive official mail there.
Do I have to provide my private home address?
For private individuals: yes, unless you have a commercial business location. You can use your business address if you have registered one with the trade office. Data protection is no excuse — in this case German courts place transparency above the protection of personal data.
What about social media links? Are they mandatory?
No, but highly recommended. Although not legally required, links to your official profiles (LinkedIn, Facebook) build trust and help demonstrate credibility. Many legal experts consider them part of "appropriate means of contact".
Do I need separate Impressum pages for subdomains?
Yes — every standalone website or subdomain needs its own Impressum if it is operated independently (e.g. blog.yourcompany.de vs. shop.yourcompany.de). With shared ownership and branding, a central Impressum with clear navigation links is permitted.
Am I allowed to copy someone else's Impressum?
No. You may not simply copy another site's Impressum: the details would be wrong for your own site, and the wording may be protected by copyright, so copying can raise copyright or unfair-competition (UWG) issues. However, it does not constitute criminal fraud under § 263 StGB. Every entity must provide its own accurate details — even if the template looks similar.
Does my Impressum have to be in German?
Yes, if your audience is predominantly German-speaking. If you serve an exclusively international audience, English may suffice — but for any site targeting Germany/Austria/Switzerland, German is mandatory.
How often must I update my Impressum?
Immediately after any change: new address, phone number, company name or legal form (e.g. sole proprietorship → GmbH). Outdated details count as a violation. Set a reminder for an annual review.
Can I use an automated service like yours instead of a lawyer?
Yes — our generator creates legally valid templates that comply with § 5 DDG and the UWG. However, if you operate in regulated industries (finance, health, legal services), consult a lawyer to make sure additional details are included (e.g. professional liability insurance information).
What is the difference between the Impressum and the privacy policy?
Impressum = who you are (identity & contact).
Privacy policy (Datenschutzerklärung) = how you handle data (data protection policy).
Both are legally required. They are separate documents — but are often linked together in the footer.
Do I need an Impressum for my Instagram or Facebook page?
If your social media profile promotes goods/services: yes. German courts have ruled that business Instagram profiles must display a link to the Impressum (e.g. "Impressum: https://yoursite.de/impressum").
Can I add an Impressum after launch?
Technically possible — but risky. If someone files a complaint before you add it, you are already in violation. Best practice: add the Impressum before going live.
